GENERAL AFFIDAVIT.

STATE OF Ohio, COUNTY OF Preble SS

In the matter of Lovina Mullen widow of Alfred Focht late a Private in Co. F of the 131st Reg't of Ohio Inft. Vols., for Widow's Old Law.

On this 15th day of August, A.D. 1906, personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths, Philip Andrews, aged 59 years, a resident of Gratis in the County of Preble and State of Ohio whose Post office address is Gratis, Preble Co., Ohio, and Seth Burnett, aged 77 years, a resident of Gratis in the County of Preble and State of Ohio, whose Post office address is Gratis, Preble Co., Ohio and well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows:

That they have been well and personally acquainted with Lavina Mullen for 40 years, and 50 years, respectively and that each of them well remembers when the said Alfred Focht and Lavina Zimmerman, (now Lavina Mullen) were united in marriage, and as they now remember, and as they believe from [ . . . ] Alfred Focht, which was in the 9th day of September, 1873, the said Alfred Focht and Lavina lived together as man and wife and were recognized in the community in which they lived as man and wife until the death of said Alfred Focht. That we each knew the said Alfred Focht and Lavina Zimmerman from the time each arrived at marriageable age, and we each well knew that neither of them had ever been married before their marriage to each other June 28, 1866. And affiants further say they well know the the said Alfred Focht and Lavina his wife lived together as husband and wife from the date of their marriage until the death of said Alfred Focht, and that neither of them were divorced from the other at or during said time, but at all times lived together as man and wife. And affiants further say that after the death of the said Alfred Focht, and as they are informed and believe, the said Lavina Focht was on the 9th day of December 1882 again married to one Curtis Mullen, and the said Curtis Mullen is long since deceased as we are informed and believe.

And we further say that during the time the said Alfred and Lavina Focht were living together as husband and wife there was born to them four children, all of whom are yet living, and from our remembrance and from a family bible, the said children were born as follows

Fermen C., born May 30th, 1867, who now resides at Winchester, Indiana

Carrie, born January 13th, 1869, who now resides in Dayton, Ohio

Hattie Belle, born June 7th, 1870, who now resides at Winchester, Indiana

Bert, born October 22nd, 1872, who now resides in Gratis, Ohio

All of said children were under sixteen years of age at the date of the death of their father and are all now living.

We further declare that we have no interest in said case, and are not concerned in its prosecution.

Sworn to and subscribed before me this 15 day of August, A.D. 1906 by the above-named affiant, and I certify that I read said affidavit to said affiant, including all the words erase, and all the words added, and acquainted -- with its contents before I executed the same. I further certify that I am in no wise interested in said case, nor am I concerned in its prosecution; and that said affiants are personally known to me and that they are credible persons.
