Declaration for Remarried Widow's Pension

SECTION 2, ACT OF SEPT. 8, 1916

State of Ohio, County of Preble, ss:

On this 30th day of September A.D. 1916, personally appeared before me, a Justice of the Peace within and for the County and State aforesaid, Lavina Mullen, who, being duly sworn by me according to law, declares that she is sixty-nine years of age, and that she was born April 22nd, 1847 at Germantown, O., Montgomery County.

That she was formerly the widow of Alfred C. Focht, who enlisted May 2nd, 1864 at Farmersville, Ohio, under the name of Alfred C. Focht, in Company "F", 131 Reg. Ohio Inft. Vols., and was honorably discharged at Camp Chase, Ohio, Aug. 25th, 1864 having served therein during the Civil War.

That otherwise than herein stated said soldier (or sailor) was not employed in the United States service.

That she was married to said soldier (or sailor) June 28, 1866, under the name of Lavina Zimmerman, at Winchester, Preble County, Ohio, by A. Stiver, J.P., Preble Co., O.; that she had not been previously married; that he had not been previously married.

That said soldier (or sailor) died September 9th, 1873 at Gratis, Ohio, Preble County; that she was not divorced from him.

That she was not formerly pensioned as the widow of said soldier (or sailor), . . .

That she did marry again after the death of the soldier (or sailor), to Curtis Mullen, on December 9, 1882, at Gratis, Ohio. That said Curtis Mullin died February 9, 1895, at Liberty, Indiana. At the time of his death, affiant and Curtis Mullen were not living together but they had never been divorced.

That she makes this declaration for the purpose of being placed on the pension roll of the United States, as a remarried widow, under the Second Section of the Act of Congress Approved September 8, 1916.

She hereby appoints J.B. CRALLE & CO. (Their successors or legal representatives) Pension Attorneys, Cralle Building, 108 C Street, N.W., Washington, D.C. her true and lawful attorneys to prosecute her claim.

That her post office address is Gratis, County of Preble, State of Ohio.

Also personally appeared Eli H. Morris, residing at Gratis, Ohio, and Philip Andrews, residing at Gratis, Ohio, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say they were present and saw Lovina Mullen, claimant sign her name (or make her mark) to the foregoing declaration; that they have every reason to believe from the appearance of said claimant and their acquaintance with her for 55 and 56 years, respectively, that she is the identical person she represents herself to be; and that they have no interest in the prosecution of this claim.
